1Agreement and User Eligibility
1.1 A Binding Contract
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Schultee ("we", "us", "our"). By accessing the Schultee mobile application, website, or any associated APIs (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you are prohibited from using the Service.
1.2 Age and Jurisdictional Eligibility
The Service is intended for a global audience. However, you must be at least 13 years of age (or the minimum legal age in your country) to create an account. If you are under the age of majority in your jurisdiction (typically 18), you represent that you have received parental or guardian consent to use the Service. Users in sanctioned countries or individuals on restricted-party lists are prohibited from using the Service.
1.3 Account Security and Integrity
If you register an account, you are solely responsible for maintaining the confidentiality of your credentials. You agree to provide accurate information and to update it as necessary. Any activity originating from your account—whether authorized by you or not—is your legal responsibility. You must notify us immediately of any unauthorized breach of your account's security.
2Cognitive Disclaimer & Intended Use
2.1 Not a Medical Device
Schultee is an entertainment platform designed for cognitive exercise and brain training through gamified challenges. THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION, including but not limited to ADHD, dementia, Alzheimer's, or clinical cognitive decline.
2.2 No Guarantee of Results
Individual results from using Schultee vary significantly. While the game leverages principles of neuroplasticity and cognitive load, we make NO GUARANTEE that using the Service will lead to improved real-world performance, higher IQ scores, or any specific cognitive benefit. Any "Cognitive Scores" or "Brain Age" metrics displayed within the app are strictly gamified metrics for comparative use within our platform and hold no clinical validity.
Always consult with a qualified healthcare professional regarding any concerns about your cognitive health or mental performance.
3Fair Play, Integrity, and Prohibited Conduct
3.1 Zero-Tolerance Anti-Cheat Policy
The competitive integrity of Schultee is paramount. To maintain a level playing field, the following activities are strictly prohibited:
- Automation Tools: Use of bots, macros, auto-clickers, or any software that automates input.
- AI Assistance: Using computer vision or AI models to "solve" patterns or speed up reaction times.
- Hardware Modification: Using modified controllers, overclocked touch-digitizers, or network-lag switches.
- Memory Tampering: Modifying the application's memory state via external debuggers or hex editors.
- Match Manipulation: Collusion or "wintrading" to artificially boost leaderboard rankings.
3.2 Investigative Rights
We employ rigorous server-side telemetry to monitor for unnatural performance spikes (e.g., 0ms reaction consistency). We reserve the right—without prior warning—to wipe leaderboard scores, suspend accounts, and permanently ban hardware IDs of users found in violation of this section.
3.3 General Harassment
If using social or multiplayer features, you must not engage in harassment, hate speech, or the distribution of malicious software. We may moderate user-generated content (like room names) and delete any content that violates community standards.
4Virtual Real Estate, Passes, and Subscriptions
4.1 Limited License on Virtual Items
"Room Passes," avatars, and other digital assets ("Virtual Items") are not your personal property. Instead, you are granted a limited, revocable, non-transferable license to use these items solely within the Service. Virtual Items have no "real world" value and cannot be exchanged for cash or legal tender.
4.2 Finality of Purchases
All transactions initiated via Google Play or the App Store are FINAL and NON-REFUNDABLE. We do not provide cash refunds or credits for partially used subscription periods or unused Room Passes. For technical errors where a purchase is not delivered, we will provide an in-game grant of the equivalent item upon verification.
Subscriptions will automatically renew at the current rate unless canceled via your device's subscription settings at least 24 hours before the renewal date.
5Intellectual Property Rights
5.1 Ownership: All aspects of the Service—including graphics, source code, game mechanics, soundtracks, logic puzzles, and brand identity—are the exclusive property of Schultee and its licensors, protected by international copyright, trademark, and trade secret laws.
5.2 User License: We grant you a personal, non-exclusive license to use the app for its intended purpose. You may not copy, modify, distribute, or reverse engineer any portion of the software without our express written permission.
5.3 Feedback: If you suggest new game modes or features, you grant us a royalty-free, perpetual license to implement those ideas without any compensation to you.
6Liability, Indemnity, and Warranty Disclaimer
6.1 "AS-IS" PROVISION: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2 LIMITATION OF DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHULTEE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD-PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS.
6.3 INDEMNIFICATION: You agree to defend, indemnify, and hold harmless Schultee and its officers, directors, and employees from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or your violation of these Terms.
7Mandatory Arbitration & Class Action Waiver
7.1 Informal Resolution: For any dispute you have with us, you agree to first contact us at contact@schultee.com and attempt to resolve the dispute with us informally.
7.2 Binding Arbitration: ANY DISPUTE ARISING OUT OF THESE TERMS SHALL BE RESOLVED THROUGH BINDING ARBITRATION rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
7.3 CLASS ACTION WAIVER: YOU AND SCHULTEE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
8General Provisions
8.1 Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
8.2 No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
8.3 Governing Law: These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which our primary corporation is registered, without regard to its conflict of law provisions.
8.4 Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between us regarding our Service and supersede any prior agreements.
